These Terms and Conditions govern Farming at Plantation Succour, operated by Food Farm Gardens St. Maarten (FFG), an initiative of Stichting Marlin Yard. By applying for a partnership, you agree to abide by these terms and conditions.

Acceptance of Terms
By applying to and participating in the Food Farm Gardens (FFG) Farmer Partnership Program, you agree to these Terms & Conditions. These terms constitute a legally binding agreement between you and FFG, governing your participation in our agricultural partnership program at Plantation Succour, Sint Maarten.
Partnership Tiers and Eligibility
2.1 FFG offers three partnership tiers: Land Only, CSA Partnership, and CSA + Cooperative Partnership
2.2 Applicants must be 18 years or older
2.3 All applicants are subject to a review and approval process
2.4 FFG reserves the right to reject any application without providing specific reasons
Financial Terms
3.1 Annual partnership fees are due in advance upon acceptance
3.2 Fees are non-refundable after plot assignment
3.3 Late payment may result in partnership suspension
3.4 Pricing is subject to change with 30 days’ notice
3.5 Emergency support fees for CSA Partnership are mandatory and non-negotiable
Plot Assignment and Usage
4.1 Plot assignments are made at FFG’s discretion
4.2 Farmers must cultivate at least 75% of their assigned plot
4.3 No subletting or transferring of plot rights is permitted
4.4 Plots must be used for approved agricultural purposes only
4.5 Plot usage must comply with organic standards and site rules
Organic Standards and Compliance
5.1 All farmers must adhere to strict organic cultivation standards
5.2 Synthetic chemicals are strictly prohibited
5.3 Annual organic compliance inspections will be conducted
5.4 Violations may result in warning, fines, or partnership termination
Heritage Preservation
6.1 Farmers must respect and preserve historic site features
6.2 No alterations to historic structures are permitted
6.3 Archaeological discoveries must be immediately reported
6.4 Participation in heritage preservation activities is encouraged
Community Standards
7.1 Respectful conduct is mandatory
7.2 Discrimination, harassment, or hostile behavior is prohibited
7.3 Cooperative members must attend required meetings
7.4 Community participation is expected
Termination of Partnership
8.1 FFG may terminate a partnership for:
Repeated policy violations
Non-payment of fees
Destructive or dangerous behavior
Failure to meet cultivation requirements
8.2 Farmers may voluntarily terminate with 30 days’ notice
8.3 No refunds will be issued after plot assignment
Liability and Insurance
9.1 Farmers are responsible for personal injury and property damage
9.2 FFG recommends individual crop and liability insurance
9.3 FFG is not liable for crop failures, weather events, or personal accidents
9.4 Cooperative members may access group insurance options
Intellectual Property
10.1 All IP created during partnership remains FFG property
10.2 Farmers may not use FFG branding without written permission
10.3 CARET tokens and Eco Shares are non-transferable
Data and Privacy
11.1 Personal information is subject to FFG’s Privacy Policy
11.2 Farmers consent to data collection for partnership management
11.3 GDPR and Caribbean data protection laws apply
Dispute Resolution
12.1 Internal mediation is first step for conflict resolution
12.2 Disputes will be resolved in Sint Maarten jurisdiction
12.3 Cooperative board may act as neutral arbitrator
Changes to Terms
13.1 FFG may update terms with 30 days’ notice
13.2 Continued participation implies acceptance of new terms
Force Majeure
14.1 FFG is not liable for uncontrollable events like hurricanes
14.2 Emergency support systems will activate during such events
Governing Law
These terms are governed by the laws of Sint Maarten and the Netherlands.
